Townsville Court: Caleb William Robert Rutherford who allegedly murdered Josh Hyde scheduled for trial in 2025

The murder trial involving an NQ man who was charged with fatally stabbing a 20-year-old in Ingham won’t be held until the New Year following already significant delays.

A North Queensland murder trial that has already experienced significant delays has been scheduled to occur in the New Year almost four years on since a man was allegedly stabbed walking home.

Ingham man Caleb William Robert Rutherford was charged with murder in 2021 after 20-year-old Josh Hyde was allegedly fatally stabbed.

On Tuesday morning in Townsville Magistrates Court Mr Rutherford’s lawyer Jamie Scuderi from Purcell Taylor Lawyers addressed the court in relation to the man’s separate 20 charges and asked for an adjournment as the man’s murder charge has continued.

“Mr Rutherford has a murder indictment in the Supreme Court that’s listed for pre-trial arguments for December 2,” Ms Scuderi said.

“A trial listing date is expected in the New Year.”

Magistrate Richard Lehmann asked if there would be an adjournment for the separate charges to await the outcome of the murder trial and suggested the matters be adjourned to December this year, to which Ms Scuderi agreed.

The murder charge had already suffered significant delays due to Covid-19 border control restrictions which put a stop to police travelling with Mr Rutherford’s phone that authorities needed to download and analyse evidence from, furthermore in October 2022 the case hit a roadblock due to outstanding police statements.

Mr Rutherford’s separate 20 charges include serious assault of a corrective services officer, unlawful use of a motor vehicle, possessing a knife in a public place, possessing unauthorised weapons and stealing.

Those matters have been listed for mention in Townsville Magistrates Court on December 17.

The prerecording for the murder trial evidence is listed to take place on December 2 this year in Townsville Supreme Court, no date has been confirmed for the trial.

Mr Rutherford is currently remanded in custody at Maryborough Correctional Centre.
