Victims outline drastic impact of the ‘heartless’ actions of longtime criminal

A 34-year-old man who threw a disgusting cocktail of bodily fluids at a prison guard had assaulted her in a ‘demeaning and appalling way’, a Supreme Court judge said in sentencing.

Justice Michael Brett made his comments after hearing a ‘detailed and eloquent’ victim impact statement on the effect of and assault by Codie Ken Fazackerley on April 9, 2025.

He pleaded guilty to the assault of the prison guard at the Launceston Reception Prison.

Fazackerley also pleaded guilty to armed robbery for stealing cash and two bottles of alcohol from the Park Hotel at Invermay earlier the same day.

“About 3.30pm the accused was in his cell when he vomited into the toilet,” a prosecutor told the court.

“When the complainant opened the hatch he threw vomit, toilet water and faecal matter which landed on her clothes, face and went into her mouth.”

In her 15-minute victim impact statement the woman outlined how the assault created an agonising six month wait for medical test results and contributed to a breakdown of a relationship.

She said that she had to tell a new partner that she would be unavailable for intimacy because of possible infection.

“The first month was excruciating and my relationship was suffering,” she said.

“The ban on intimacy remained and my relationship ended.”

She said the assault resulted in saturated and her torso was completely covered as well as going into her ears, eyes and mouth.

The court heard that Fazackerley was barefoot and carrying a metal pole when he entered the Park Hotel in Invermay at about 10am.

He attempted to enter the kitchen and was met by a bar attendant who asked if he was okay.

“The accused followed her into the bar area and used the pole to hit a display cabinet causing patrons to evacuate,” the court heard.

He yelled at staff member and reached over the bar and used the key to open the till and remove $1372.

“The accused gained access to the bar area and stole a bottle of Johnny Walker red label and poured it over the bar and then ran out the rear door leaving the metal pole behind,” the court heard.

Fazackerley then ran to a car dealership and demanded a car but was refused and told to leave.

The bar attendant also made a victim impact statement in which she revealed that she experienced flashbacks and disrupted sleep.

“I’m angry that this happened to me and bitter that I must live with this memory,” she said.

Justice Brett said the crimes were very serious.

“The [armed robbery] complainant suffered an immense impact because of what you did – and that is not surprising,” he said.

He said the offending was heartless and that Fazackerley had shown no concern about the effect of his actions.

He related Fazackerley’s history of serious crimes which included jail time for assault, aggravated armed robbery, and a 29 month sentence for wounding in September 2023.

“You were subject to a four month suspended sentence at the time of this offending,” he said.

“These crimes were committed a relatively short time after your release from prison.

“In my view the only possible sentence is a significant term of imprisonment.”

Justice Brett activated the four month suspended sentence and added two years and six months for the armed robbery backdated to April.

“For the assault I sentence you to fifteen months jail cumulative to the armed robbery sentence.

“The total term is four years imprisonment.”

He set a non parole period of three years.
