A woman who was allegedly drink driving when she struck a pedestrian had been disqualified from driving less than two months ago, a court has heard.
Lisa Maria Trewren, 38, of Murray Bridge was allegedly driving along Mt Barker Rd at Totness about 11.15pm on Monday, with her 13-year-old son in the vehicle, when she struck the 31-year-old pedestrian.
On Wednesday morning, police said the pedestrian, who was walking along the side of the road, died overnight and a charge of causing serious harm by dangerous driving has now been upgraded to a charge of aggravated causing death by dangerous driving.
Ms Trewren appeared in the Adelaide Magistrates Court on Tuesday seeking release on home detention bail.
A police prosecutor told the court Ms Trewren had appeared in the Murray Bridge Magistrates Court on October 25 where she was disqualified from driving for 12 months for drink driving after an incident in May.
He said she had returned a positive roadside breath test for alcohol after the crash on Monday, but refused a further breath analysis when taken back to the Mount Barker Police Station.
“Bail is opposed on the basis of the seriousness of the offending,” he said.
“The fact is she, not two months ago, attended court and was issued with a disqualification – a very simply order of the court to abide by.
“She … failed to abide by that order … if the defendant can’t comply with a simple order such as the disqualification, how can she comply with bail?”
The prosecutor said a witness had reported seeing the pedestrian walking southeast along the eastern bitumen shoulder of the road.
“The front left of the defendant’s vehicle collided with the pedestrian, and as a result he was taken to the Royal Adelaide Hospital,” he said.
He said a witness who had been driving along the road had seen the victim, but when he returned several minutes later the victim was lying on the road’s edge.
“(The witness) saw a vehicle stationary approximately 150m southeast, parked on the road, saw the smashed front windscreen,” the prosector said.
“The female inquired as to whether this witness was the person she hit with the car.”
The court heard Ms Trewren was issued with a further 12-month loss of licence after the crash.
Magistrate Simon Smart ordered a home detention report. Ms Trewren was remanded in custody to a date next week.
