Juror discharged from trial of eight alleged Hells Angels accused of murdering Jason De Ieso

A juror has been discharged from the murder trial into the 2012 murder of innocent Pooraka panel beater Jason De Ieso.

A juror has been discharged from the mammoth murder trial of innocent panel beater Jason De Ieso after an almost two week break, mostly due to illness among jury members.

Justice Brian Martin, who is presiding over the trial, told the remaining jury members that one of them would no longer be part of the group tasked with returning a verdict at the conclusion of the trial.

“I have this morning, and I confirm it, made an order that (a juror) is discharged from further sitting on this jury,” he told the jury.

“There are matters that have been raised with me by the juror and I have reached the view that the juror should not be sitting further on this trial.”

A jury normally consists of 12 members but fifteen were empaneled at the start of this trial due to its expected length of up to six months. The trial has heard that if more than 12 remain at the culmination of evidence, a ballot will be held to decide which 12 members will deliver a verdict.

Mr Martin told the remaining jury members that they must not contact the juror who had been discharged.

“You may well have exchanged personal details, I don’t know. But you should not have any contact with (the juror) from now until after the trial has concluded.”

“That juror now, is in the same position as a member of the public.

“If you run across them somewhere socially, or whatever, and you start chatting – please don’t – that would cause major problems.”

He said he hoped the break from sitting had been a “circuit breaker” to any further illness among jury members.

Eight men are accused of murder of Mr De Ieso who was gunned down inside his Pooraka panel beating workshop on November 21, 2012, amid an escalating bikie war involving members of the Hells Angels and the Finks.

At the opening of the trial, Jim Pearce KC, told the jury that a member of the Finks, Charles Bonnici, was the alleged target of the attack and was known the frequent the workshop.

The eight accused men are Husain Alzuain, 35, of Goodwood, Mohamed Alzuain, 31, of Mile End, Musa Ali Alzuain, 30, of St Morris, Daniel Mark Jalleh, 34, of Clovelly Park, Ross William Montgomery, 38, of Andrews Farm, Seywan Moradi, 36, of Walkley Heights, Kyle Lloyd Pryde, 34, of Adelaide and Nicholas Sianis, 36, of Beverley.

They have each pleaded not guilty to a charge of murder.

Mr Pearce had told the court that the accused are each alleged to be members, or closely associated with, the Hells Angels bikie gang.

Since the opening of the trial, multiple witnesses have given evidence, including those in the workshop at the time, a man who alleges he was given a clean-up order after the incident and witnesses to a firebombing at the Alzuain family home on the evening before the alleged murder.

The trial continues.
