The woman accused of assisting in the alleged murder of top surgeon Michael Yung has faced court for the first time since her release on bail – without a lawyer.
On Wednesday, an unrepresented Jacinta Davila asked the Adelaide Magistrates Court to adjourn her case due to an issue of finances.
“They (my lawyers) told me that they are waiting for my legal aid documents to come through,” she said from the dock.
“They asked me to just request an adjournment.”
The court agreed – outside the building, Ms Davila used a file folder to hide her face, and buried her head into the shoulders of her supporters, to avoid the media.
A passer-by then offered her their own backpack, which she took and used to shield her face as her group walked into an Angas St cafe.
She used the bag again when leaving the cafe and getting into a waiting taxi, declining to answer any questions.
Mr Aydin, 23, has yet to plead to one count of murder and aggravated serious criminal trespass in a place of residence.
Ms Davila, 28, has yet to plead to assisting an offender.
Previously, prosecutors had alleged the couple broke into Dr Yung’s home at Gilberton, via a ladder through an upstairs window, with the intention of stealing property.
They had further alleged the couple encountered Dr Yung and, after a scream and a loud noise was heard, he was found with critical head and spinal injuries from which he later died.
It was further alleged they were arrested after they shoplifted medical supplies from shops at Torrensville to treat wounds he sustained in the incident.
In December, prosecutors dropped the murder charge against Ms Davila, who was granted bail in order to care for the “on-off” couple’s eight-month-old child.
In court on Wednesday, prosecutor Sarah Attar said her office had finalised the charges against the duo.
Mr Aydin, she said, would be prosecuted on one count of murder and one count of aggravated serious criminal trespass in a place of residence.
Ms Davila, she said, would only be prosecuted on one count of assisting an offender, asking the court to remove any remaining murder allegation against her from its files.
Ms Attar said much of the evidence gathered against the duo had already been provided to defence counsel, but there was more to come.
“I’m confident we will have a post-mortem report by September, and ask Your Honour set an answer charge date late in that month,” she said.
“We are still awaiting completion of the DNA analysis report.”
James Noblett, for Mr Aydin, did not oppose the delay.
The state’s chief magistrate, Judge Mary-Louise Hribal, remanded Mr Aydin in custody and Ms Davila on continuing bail to a further hearing in May.
She ordered they enter their pleas to their respective charges in September.
“Ms Davila, I’m aware you do not have a solicitor … these are serious matters and you should continue to seek legal representation,” she said.
