A P- plater who told police he had 10 schooners at a pub on Anzac Day before getting behind the wheel of a car in the early hours of the morning was lucky not to have seriously injured anyone on the road after crashing, a court has heard.

Jydon Dolby, 21 of Bateau Bay, was sentenced in the Wyong Local Court after pleading guilty to high-range drink driving.

Police facts state that on the early hours of April 26 this year, Dolby consumed alcoholic beverages at The Lakes Hotel at The Entrance.

At about 1.30am, he drove from the pub in his partner’s white Suzuki Swift, while his partner was in the front passenger seat at the time.

“He was driving south along The Entrance Road, Long Jetty approaching the intersection of Toowoon Bay Road, when he has collided with the pedestrian island in the middle of the road,” court documents state.

Dolby has then taken out a sign post and two guard rails, before sliding out and mounting the kerb on the opposite side of the road.

The impact of the collision caused the airbags to deploy and he sustained minor injuries to his face, but declined treatment from paramedics.

The vehicle sustained extensive damage to the front end and required towing from the scene.

About 1:45am, police arrived and observed Dolby standing near the vehicle and was then breath tested.

Dolby returned a positive result and he was taken back to The Entrance police station where he returned a reading of 0.192.

He was asked a number of questions in relation to the consumption of alcohol and he told officers he drank about 10 schooners of Carlton Dry.

Magistrate Alan Railton convicted and sentenced Dolby to a community corrections order for a period of 18 months and also ordered him to undertake 75 hours of community service.

Mr Railton said the offending involved a serious set of facts, and it was lucky that no one was seriously injured.
