Caleb Uta: Blacktown man charged for assault at Huskisson Pub

A young man has been sentenced for punching another man multiple times in the head, mouth and nose at a popular south coast pub, following allegations the victim sexually assaulted someone he knew.

A young man has been sentenced for bashing someone at a popular south coast pub, after hearing the man allegedly sexually assaulted someone he knew.

The incident saw Caleb Uta, 21, appear in Nowra Local Court on Tuesday, pleading guilty to common assault.

Documents tendered to the court reveal the Blacktown man was visiting the Nowra region on March 30 this year, going to the Huskisson Pub for drinks late in the evening.

Uta’s lawyer, Neshani Chandrapal, told the court on Tuesday while her client was at the pub, he was informed another patron had allegedly sexually assaulted someone he knew some time ago.

No charges were ever laid against the man.

Agreed facts state that, following hearing the allegation, Uta walked up to the man before asking him to step aside for a word.

“I don’t want to, I’m here for a good time, I don’t want trouble,” agreed facts state the victim replied.

However, Uta then used his right fist to punch the victim in the head, pushing them back.

Agreed facts state the Blacktown man continued to punch the victim three more times in the forehead, nose and mouth.

The victim fell over during the assault, before Uta was moved away by witnesses.

Police were called to the scene where they spoke to the victim, before viewing CCTV showcasing the assault.

Following investigations, police visited Uta’s Blacktown home on May 17 where he was shown CCTV footage of the assault, before he was charged and issued a court attendance notice.

Ms Chandrapal told the court on Tuesday that her client was a young man with good intentions and no criminal history.

She said the allegations “rattled” and angered him, leading to the assault.

However, Magistrate Lisa Viney said violence was never the answer.

“This was an unprovoked attack in a public place,” she said.

“I understand the information told to you was upsetting, but you never take matters into your own hands.”

However, given Uta’s lack of a criminal history, Ms Viney said she would punish him without a conviction.

Uta was sentenced to a supervised, 12 month community release order.

“Ensure this is the last time you step foot in the criminal courts,” Ms Viney said.
