Prosecutors want Jason De Ieso murder accused Mohammed Alzuain to be declared a ‘serious and organised crime suspect’

One of five Hells Angels accused of the 2012 shooting of Jason De Ieso has appeared in court seeking bail – but prosecutors want him declared “a serious and organised crime suspect”.

Prosecutors want one of five Hells Angels charged with the cold case shooting murder of Jason De Ieso in 2012 declared a “serious and organised crime suspect”, in a move which could prevent his release on bail, a court has heard.

Mohammed Alzuain appeared in the Adelaide Magistrates Court on Wednesday seeking release on bail, but the hearing was delayed pending the prosecution application.

Michael Abbott QC, for Alzuain, said should the application be successful, his client would become a “prescribed applicant”.

Under the Bail Act, a successful declaration as a serious and organised crime suspect would remove the presumption in favour of bail, making it harder for a defendant to seek release.

“I regret that I cannot proceed with the bail application with this potential application lurking in the wind,” Mr Abbott said.

Mr Abbott said the type of application was “rare” and was likely to change his argument for seeking bail.

He told the court he received a bundle of documents “consisting of a whole series of affidavits” on which he first needed to take instructions from his client.

Jim Pearce, prosecuting, said he would not oppose a delay for defence to prepare for the application.

Alzuain is charged with murder alongside his brothers Husain Ali Alzuain, 31, and Musa Alzuain, 28, as well as Daniel Mark Jalleh, 30, and Ross William Montgomery, 34.

A sixth man, Jake Byron Martin-Herde, 31, of Salisbury Downs, is charged with one count of assisting an offender in connection to the murder.

None of the accused men have entered pleas.

Each of the men — who police allege are all either former or current members or associates of the Hells Angels — was able to be identified after a suppression order on the identity of each accused was lifted last week.

Police have also revealed a national manhunt is underway for fellow Hells Angel, Kyle Lloyd Pryde, 31, after a warrant was issued for his arrest in August on a charge of murder.

Mr De Ieso, 33, was shot dead when nine men burst into his Pooraka workshop, Unique Custom Paint and Panel, and fired several shots on November 21, 2012.

Police will allege Mr De Ieso’s shooting was the culmination of an escalating feud with the Finks.

They have previously said Mr De Ieso was an innocent bystander caught up in a dispute between the rival bikie gangs.

He was not a bikie, but was friends with a man connected to the Finks. CCTV footage from the workshop, released previously by police, shows nine men walking towards the front of the business on the day he was shot.

Mr De Ieso’s parents, Giovanna and Sam De Ieso, have previously described their son as a keen athlete in his younger years who loved fishing.

“It’s always with us, it never goes away and I don’t know why we have to go through this,” Mrs De Ieso said.

The matter will return to court later this month.
