The father of a ex-bikie murdered on the southern Gold Coast three years ago has lost all faith in the justice system after the case stalled.

Former Comanchero bikie Shane Ross and his Monstr Clothing business partner Cameron Martin were both shot dead in Tallebudgera on October 18, 2019.

Three men accused of their death – Brodie Singh, Nathan Miller and Garry Brush – all had murder charges against them dropped in the Southport Magistrates Court earlier this year after a magistrate ruled there was not enough evidence to proceed.

Throughout court proceedings the trio had maintained their innocence.

In April, the Office of the Director of Public Prosecutions (ODPP) promised a review of the decision.

The ODPP have now confirmed the review is complete.

“The review was completed and the ODPP will not be taking any further action in relation to the matter,” an ODPP spokesman said.

“Any further inquiries should be directed to the QPS (Queensland Police Service).”

That means the ODPP will not be presenting an indictment for the case.

When the Bulletin spoke to Mr Ross’s father – Les Ross – on Friday he appeared unaware of the decision.

“You’re kidding,” he said, adding the family was “not happy”.

“I don’t believe in the court system any more,” he said. “I never will again.”

Mr Ross appeared at a loss for words and repeatedly said he “did not know what to say”.

A Queensland Police Service spokeswoman said: “The Queensland Police Service (QPS) continues to investigate the homicides of Shane Ross and Cameron Martin at Tallebudgera in October, 2019.”

They declined to comment further as the investigation was ongoing.

The double murder has also been referred to the Coroner’s Court of Queensland.

Following the dismissal of the charges against Mr Miller, Mr Singh and Mr Brush, an outraged Justice Peter Davis on April 8 referred the subsequent police conduct during legal proceedings to the Crime and Corruption Commission, Queensland Police Ethical Standards Command and Police Minister Mark Ryan.

In April, Justice Davis said in the Supreme Court in Brisbane that parts of the evidence sworn by Gold Coast Detective Senior Constable Julian Libbis in April 2020 “just does not exist”.

“Here, Singh has been in custody for almost two years after making a bail application which was defeated on assertions put before the court which were plainly objectively false,” Justice Davis said in his judgment.

“That is an outrage and the circumstances of the present case ought to be investigated.”

The QPS spokeswoman said that matter was still under investigation and it would not be appropriate to comment further.
