Nathan Heath Miller denied bail, charged with injuring police officer after RBT incident at Seaton

A man has made a bail bid after allegedly fleeing from an RBT with a child in the back, causing a police officer to get trapped in the car window and breaking his leg.

A man with a child in the backseat, who allegedly trapped a police officer in his car window and then sped away from a random breath test, will remain in custody.

Nathan Heath Miller, 46, applied for home detention bail in the Adelaide Magistrates Court on Monday, after the officer was allegedly flung from the car, breaking their leg.

A prosecutor said they were opposed to all forms of bail.

The Adelaide Magistrates Court heard police were performing random breath testing duties at Elaine Ave, Seaton on April 25.

They stopped a silver Holden Captiva at about 5.15pm and spoke to the driver, who police allege to be Mr Miller – before requesting a breath sample.

“That person said that ‘he can’t stop, he can’t stop’ and began moving his vehicle forward,” the prosecutor said.

The court heard a police officer put his hand inside the car trying to remove the keys to stop the driver from driving off.

“(The driver) then wound up the window, trapping the police officer’s arm in the window and began to drive off onto the other side of the road,” the prosecutor said.

“As he then accelerated rapidly, he wound down the window and the police officer was then flung from the vehicle into a tree and two wheelie bins on the nature strip.”

The court heard the officer suffered a broken left tibia, torn tendon to his foot, abrasions and bruising and will need surgery to repair the injuries.

The prosecutor said investigations led police to Mr Miller’s ex-partner’s house who said he had attended there an hour prior to the incident and collected their five-year-old son.

The court heard there was a child in the back seat at the time of the incident.

The prosecutor said when Mr Miller was arrested at Modbury North and spoken to by police he said he didn’t know who was driving the car at the time.

“Police noted that he made attempts to change his appearance, he had shaved his facial hair and shaved his head to the skin,” the prosecutor said.

“They could still see clumps of patches of unshaven hair indicating that it had been done in a hurry and recently.”

The court heard Mr Miller was identified by the injured police officer’s colleague after a photo identification procedure.

Mr Miller, of Woodville West, is charged with endangering life and causing harm by dangerous driving.

Stacey Carter, for Mr Miller, told the court identification of the driver was an issue.

“There’s a number of different witnesses who give different accounts to the appearance of the driver,” she said.

“One of them describes the driver as having grey hair, another one describes the driver as having brown hair.

“One says chubby, one just says caucasian, one says stubble, one says no stubble.”

Magistrate Karim Soetratma refused Mr Miller bail, due to the seriousness of the allegations and risk of reoffending.

The charges were adjourned until July.
