A long standing Magistrate has regarded the assault over a young father as one of the worst he has seen, as two men avoid jail.
Max Staples, 22, and Jake Twohill, 21, received a two year good behaviour bond in the Adelaide Magistrate Court on Monday.
Earlier this year, the two men pleaded guilty to assaulting a young father and his friend adjacent to Moseley Square at Glenelg, back in 2021.
The unprovoked attack took place just before 2am on June 26, when Twohill and Staples began punching, kicking and wrestling the young father and his friend.
The assault resulted in the victims needing serious medical attention, as it caused significant brain damage to the young father after repeatedly hitting and kicking him in the head.
“He (the victim) is lying motionless on the ground, Mr Staples delivers a kick to his face and chest area,” the police prosecutor told the court at previous hearing.
“Immediately following the assaults both of the defendants in my view … appear to celebrate even going so far as to hug each other.”
When one of the victims was discharged from the hospital, shoelace marks were still present on his face.
Through three victim impact statements, the court heard the split second decision from Twohill and Staples to engage in such a violent matter has left a young family shattered and two men trying to overcome the trauma that was inflicted on them that night.
On Monday, Magistrate Kym Millard, called the event “disturbing” as he sentenced the two young men.
“It’s reasonable to suggest the incident was quite disturbing particular Mr Staples kicking the victim to the head region,” Magistrate Millard said.
“With more than 30 years on the board, it’s probably the most significant ongoing harm that I have seen.”
“And I hope the victims are able to find happier times.”
Convictions were recorded for both men.
