Tobias Tymerski jailed for indecently assaulting a 13-year-old girl at Port Pirie

A child sex offender who met his next teen victim at McDonald’s and assaulted her in public toilets says he was looking for something that made him happy.

A predator was only thinking of his own happiness when he indecently assaulted a 13-year-old girl in public toilets.

Tobias Luke Tymerski, 21, left a child with recurring nightmares after taking advantage of her vulnerability to meet his own emotional needs.

The Adelaide District Court on Friday heard Tymerski had added the victim on Snapchat a few days earlier before he saw her at Port Pirie McDonalds on December 6, 2020.

He sat next to her and put his hand on her thigh.

The victim then went to the Memorial Oval toilets.

“Whilst in the toilet block, you grabbed (the victim) by her waist and moved your hands over her breasts, thighs and buttocks,” Judge Paul Slattery said during sentencing.

Tymerski also kissed the victim and attempted to unbutton her jeans.

The victim who was feeling “immensely uncomfortable” pushed Tymerski away and ran out.

A victim impact statement was read to the court in January, with the girl saying she lives in constant fear and always questions “why me?”.

“I feel I’ve lost all trust in people,” she wrote.

“I have this one recurring nightmare of me being sexually abused again.

“I don’t want it to be like this, I want to live my life as a normal teenage girl.

“I don’t want to remember this situation but it continues to haunt me every day.”

Tymerski, of Whyalla Norrie, pleaded guilty to two counts of indecent assault.

He breached a two-year good behaviour bond with the offending.

The court heard Tymerski was convicted of unlawful sexual intercourse in February 2020 and received a suspended jail sentence.

The court heard Tymerski, who had worked at Hungry Jack’s and various labouring jobs, was remorseful for his offending.

“You and your most recent girlfriend … separated only a few days before the offending,” Judge Slattery said.

The court heard Tymerski, who had a traumatic upbringing, plunged into deep depression and started binge drinking.

When a psychologist asked Tymerski whether he had considered the age of the victim, he replied: “I was worried about that but my headspace at the time was pretty bad. I was looking for something that made me happy, I was trying to get affection from her”.

Judge Slattery revoked Tymerski’s suspended sentence bond and sentenced him to three years and three months jail, with a non-parole period of one year and eleven months.

“The need to protect individuals is never greater than for the protection of children,” he said.

“You knowingly behaved in an egocentric manner when you exploited the victim’s vulnerability, whilst simultaneously prioritising your own emotional needs over hers.”

The sentence was backdated to December 7, 2020.
