Child sex offender Tobias Tymerski indecently assaulted a 13-year-old girl at Port Pirie

A man left his victim with recurring nightmares after he indecently assaulted her in public toilets, only months after he avoided jail for sex with a child.

A girl is haunted everyday by her horrific assault, after a child sex offender preyed on her in public toilets, a court has heard.

Tobias Luke Tymerski, 21, left a child with recurring nightmares after taking advantage of her vulnerability to meet his own emotional needs.

The Adelaide District Court on Friday heard Tymerski was on his way to Adelaide to start a diesel mechanic apprenticeship when he indecently assaulted a 13-year-old girl.

Ms Reid, for Tymerski, told the court he had been adding friends of friends on Snapchat in search of intimacy after a break-up in December, 2020.

He met up with the victim in Port Pirie before going with her to the Memorial Park toilets.

“The defendant enters the toilet and a minute later the victim then enters after him,” Ms Reid said.

“Evidently the consent of the complainant does not diminish the criminality nor the repugnancy of the offending.”

A victim impact statement was read to the court, with the girl saying she lives in constant fear and always questions “why me?”.

“I feel I’ve lost all trust in people,” she wrote.

“I have this one recurring nightmare of me being sexually abused again.

“I don’t want it to be like this, I want to live my life as a normal teenage girl.

“I don’t want to remember this situation but it continues to haunt me every day.”

Tymerski, of Whyalla Norrie, had previously pleaded guilty to two counts of indecent assault.

He has been in custody since his arrest on December 7, 2020, as he breached a two-year good behaviour bond with the offending.

The court heard Tymerski was convicted of unlawful sexual intercourse in February 2020 and received a suspended jail sentence.

In that offence, Tymerski preyed on a 13-year-old girl by communicating with her over Snapchat in 2019.

They met up and Tymerski initiated sexual contact with her.

“They then went behind some nearby bins and engaged in penile-vagina intercourse,” the prosecutor said.

The prosecutor said it was concerning that Tymerski had committed the offences so close together.

“The defendant knowingly behaved in an egocentric manner whereby he exploited the victim’s vulnerability,” the prosecutor said.

“The offending has had a significant and ongoing effect on the victim.”

Ms Reid told the court Tymerski had written a letter of apology to the victim.

“Mr Tymerski has expressed deep regret to me about the traumatic impact his conduct has had on the victim,” she said.

“He acknowledges that the offending is grave.”

The court heard Tymerski, who had a traumatic upbringing, plunged into deep depression and started binge drinking.

“He had a relationship end just a few days before the aggravated indecent assaults,” Ms Reid said.

“He has admitted that he knew the victim was aged 13 and he put his own need for intimacy ahead of her safety and wellbeing.”

Judge Paul Slattery will sentence Tymerski in March.
