26-year-old man sentenced for sexually abusing and impregnating child

Two brothers have been sentenced for sexually abusing and impregnating children, with one managing to walk free from court.

A predator who impregnated a child has walked free from court but his brother wasn’t as lucky.

A 26-year-old man, who cannot be named to protect the identity of his victim, was sentenced only months after his brother was jailed for similar child sex offending.

During sentencing, the District Court heard the man became friends with the 15-year-old victim when he was 23.

The court heard the man had sexual intercourse with her in the Upper Spencer Gulf region when she was 16 and their son was born in May 2022.

After the child was born, the man and the victim formed a relationship and have been together since.

The northern suburbs man pleaded guilty to a charge of unlawful sexual intercourse.

Due to his youth and intellectual disability, he was sentenced to a $1000, two year good behaviour bond.

“In fact, you say that before having sexual relations with your partner, you asked your mother if that was all right and she said it was,” Auxiliary Judge Gordon Barrett said.

The court heard the man’s brother was also sentenced earlier this year for unlawful sexual intercourse with a different child.

His offending involved a 15-year-old girl he met on Snapchat at the end of 2020.

The man sexually abused the victim in December 2020 and she realised she was pregnant in January 2021.

The man and the victim continued to communicate by Snapchat and their baby girl was born in September 2021.

The court heard the man visited the victim in Adelaide on the weekends, where he continued to sexually abuse her.

On November 17, the victim’s child was removed from her and a DNA test was conducted.

The test results confirmed the man was the child’s father.

The court heard the man initially denied having sex with the victim until after the result of the DNA test.

Auxiliary Judge Barrett sentenced the Upper Spencer Gulf man to two years and one month jail, with a non-parole period of one year.
