Summer Ruru had home detention breaches excused after violent robbery of partner

A state cricket star who convinced her ex to bash her new partner with a bat, and also fake her abduction, has dodged jail a second time after she couldn't stay off drugs.

A mother who couldn't stay off drugs after she recruited her ex to bash her new partner in a violent robbery has dodged jail a second time.

Summer Apimaira Ruru, 26, was given another chance by the court after she breached her home detention order by returning positive drug tests.

Ruru, who pleaded guilty to serious criminal trespass, theft and assault, was ordered in November to serve her two years and nine months jail term, with a non-parole of one year and seven months on home detention.

Ruru’s ex-partner Karl John Hassan, 34, was jailed for his role in their cunning plan after they were caught “red handed”.

During sentencing, the court heard Ruru had been in a relationship with the victim for about a month.

“You say that relationship was an unhealthy one and marked by domestic violence,” Judge Timothy Heffernan said.

“And things got to a point where you desperately needed to find a way out.”

The court heard Hassan, who shared a child with Ruru, contacted her and they instigated a plan.

The court heard Hassan and three associates arrived at midnight on October 28, 2018 at Morphett Vale, where Ruru had left the door unlocked.

“You burst in through the front door and into the victim’s bedroom … you, Hassan were wearing a hockey mask,” Judge Heffernan said.

The court heard Hassan and his associates, also wearing disguises, were armed with baseball bats and sticks.

“The victim was struck with bats by at least two of you to his neck, head and arm,” Judge Heffernan said.

“During the assault one of the assailants held what the victim believed to be a taser to his face and someone threatened to stab him.”

The group stole the victim’s phones, money and bank cards.

“He believed that you, Ms Ruru had been abducted which is what you wanted him to believe to avert suspicion from yourself,” Judge Heffernan said.

Police attended Hassan’s house and caught them “red handed”.

Hassan, of Taperoo, was found guilty at trial of assault and theft and was jailed for three years and seven months jail, with a non-parole period of two years and two months.

During sentencing submissions in May, Mike Norman, for Ruru, said she was now determined to give home detention a “real go”.

“Drugs, the lifestyle, it takes time to get it out of your system, to grow out of it and that process has been happening and she is a different person now than she was,” he said.

“She is coming to terms that however bad home detention is – and it is bad … jail is worse.”

The court heard Ruru had previously played cricket for New South Wales and had “enormous” family support for her drug rehabilitation.

Judge Heffernan told the District Court last week he was giving Ruru an opportunity to continue her rehabilitation and excused the breaches.

“I am hopeful that there will be no further slip-ups,” he said.

I have some confidence that will be the case, but ultimately the person who has to have that confidence is you.”
