Scott Moyle faces Christies Beach Magistrates Court for drink driving

A southern suburbs man who blew almost five times the legal limit has apologised for drink driving after a fight with his girlfriend when she cut up his ex-wife’s wedding dress.

A Seaford Rise man who blew almost five times the legal limit has apologised to the public and police for his behaviour.

Scott Moyle, 46, has told Christies Beach Magistrates Court on Monday that he had “monumentally messed up” when he recorded a blood alcohol reading of 0.246 on June 6.

Mr Moyle was pulled over by police at 1.30am after they spotted his white Holden driving slowly and swerving on Griffiths Drive at Seaford Rise.

When police spoke to Mr Moyle, he was slurring his words, unsteady on his feet and said “I’m in trouble” when getting out of the car.

On Monday, Mr Moyle pleaded guilty to driving under the influence of alcohol.

He told the court he had drunk a few beers during the day while gardening but then he had got into an argument with his girlfriend.

“She got really upset and went through the garage and basically smashed all the photos of me and my ex wife and all our wedding albums and threw them in the bin,” Mr Moyle said.

“Then she got (my ex-wife’s) wedding dress and chopped it up with a pair of scissors so I thought ‘I’m not hanging around for this’ so I left.”

Mr Moyle drove to his brother’s home in Huntfield Heights and drank a few glasses of wine before leaving to drive home an hour later.

“I’ve been driving for 25 years and I’ve been pulled over at least 20 or 30 times on breathos and I’ve always responded with a negative reading but this time I messed up big time,” he said.

“I’d just like to also apologise to the general public for putting myself in that position and putting them in danger and also wasting police resources.”

Mr Moyle was issued a 12-month instant loss of license at the time of the offence.

Magistrate Rodney Oates extended the disqualification by an additional three months and ordered Mr Moyle pay $1400 in fines.
