A southern suburbs couple who allegedly used an Uber to aid in their brazen daylight assault and robbery of a man, will face trial.
Kristen Taylor, 32, and Nicholas Mardigan 36, pleaded not guilty to their charges of commit theft using force in the Adelaide Magistrate Court last week.
At a previous hearing, the court heard Ms Taylor and Mr Mardigan were in an Uber back in March with other passengers when they demanded the driver stop on Ayleen Ave in Morphett Vale.
Police alleged Ms Taylor had sighted the victim on the side of the road and requested that the vehicle stop.
“The other passengers of the vehicle got out, stole his property, the assault was quite serious,” the police prosecutor said.
The court heard the alleged victim suffered a number of injuries including facial fractures and lacerations to his face due to being hit with a club-like object and punched in the head while on the ground.
Police alleged they obtained clear CCTV from the Uber that shows all the occupants of the vehicle and the robbery occurring.
“She (Taylor) remained in the vehicle, she left the vehicle for a short amount of time but when the Uber attempted to drive away she returned and instructed him to pick up the other offenders,” said the prosecutor.
As for Mr Mardigan’s alleged offending, police say he also remained in the vehicle for sometime before also allegedly engaging in the offending.
“He was in the rear seat and did not leave the vehicle when he other co-accused did, he got out later when Ms Taylor did and also instructed the Uber driver to drive,” the police prosecutor said.
Mr Mardigan and Ms Taylor’s co-accused Brenton Taylor did not attend court on the last occasion and a warrant for apprehension was endorsed.
The couple will face court again in December.
