Kai Maxwell Fallows denied bail, charged with multiple serious domestic violence offences

An accused domestic abuser bound, gagged and bashed a woman before urinating and defecating on her in a “gruesome” act, police allege.

Communities need to take a 'stronger stance' on domestic violence

EDITOR'S NOTE - All charges were dropped in April 2024.

A man allegedly bashed a woman until she lost consciousness, stemming from a background of “gruesome” acts, police will allege.

Kai Maxwell Fallows, 34, applied for bail in the Adelaide Magistrates Court on Tuesday, accused of horrific violence.

A prosecutor opposed Mr Fallows’ release on bail, saying they were particularly concerned for the safety of the alleged victim.

The court heard Mr Fallows allegedly assaulted the woman in September – resulting in her jumping out of the bedroom window to flee from him.

The court heard the woman then woke up the next day and Mr Fallows allegedly punched her five to six times to the side of the head.

They then began to argue, the court heard.

“She heard the accused run towards her and felt a thud to the back of her head,” the prosecutor said.

The court heard the alleged victim lost consciousness and woke up face down on the floor – sustaining injuries, including chipped teeth and a perforated ear drum.

The prosecutor said the woman alleged prior violence by Mr Fallows, remembering a specific “gruesome” incident in November last year.

“She indicates … she was locked in a shed, tied to an outdoor chair with rope and cables and a number of sex tools were used on her,” the prosecutor said.

“The accused … defecated and urinated on her and she indicates that he physically abused her by slapping her, punching her, gagging her with a rag.”

Mr Fallows, of Myponga, is charged with multiple offences, including choking and assault causing harm.

Sean Nottle, for Mr Fallows, told the court there was a witness for one of the alleged incidents who said she saw no physical violence between Mr Fallows and the woman.

Mr Nottle said the woman’s allegations of the choking charge seemed to be “a little bit incredulous”.

“She has somehow alleged that her forearm has ended up … across her own neck for the accused to then stand on,” he said.

Magistrate John Wells disagreed.

“I don’t find that implausible at all … it’s entirely consistent with her protecting herself,” he replied.

Mr Nottle said the alleged victim has a history of mental illness and substance abuse issues.

The court heard Mr Fallows would be contesting the charges and had work available at a trucking company if released on bail.

Mr Wells refused Mr Fallows bail and adjourned the charges until next month.
