An Aldinga Beach man charged with assaulting and biting a woman in her home has been denied bail – partly due to COVID restrictions.
Yesterday, the Christies Magistrates Court ruled Jesse Michael Normandale unsuitable for release while the state operates under pandemic conditions.
Normandale, 22, has yet to plead to allegedly trespassing into the woman’s home and attacking her while her three children barricaded themselves in a bathroom.
In court, Magistrate Lynette Duncan said Normandale had been charged with an aggravated count of trespassing, which meant he could not be given bail unless his lawyers proved his personal circumstances were special – and they had not.
“Parliament has made the defendant a prescribed applicant during the current major emergency period given the nature of the aggravated trespass in residence charge,” Ms Duncan said.
“One of the reasons for that is people are spending a lot more time at home during the current pandemic.
“I consider this is the type of matter parliament was contemplating when they made those charged with offences such as these prescribed applicants.”
Ms Duncan refused Normandale’s bail application due to the seriousness of the offence and on the grounds that special circumstances had not been met.
“These allegations are extremely serious,” Ms Duncan said.
“In fact it’s difficult to imagine a more serious home invasion than what is alleged to have occurred here by way of a stranger entering a person’s home where children are present, attacking and injuring her with her children barricading themselves in another room and … the woman ultimately fighting off the offender.”
Normandale will remain in custody and face court again in July.
On Monday, the court heard Normandale had been drinking alcohol on the day of the offence and didn’t remember the alleged attack.
The 35-year-old victim was allegedly punched and bitten on the face and arms and later required surgery to treat her facial injuries.
