Graham Gardner sentenced for gardening masturbation

An elderly man has been sentenced for his disgusting garden habit – and has told a court he can’t explain why he does it.

An elderly man could not provide a reason as to why he proceeded to masturbate to his neighbour gardening, saying it is not the first time he’s done it.

Graham Gardner – originally from Tumby Bay – pleaded guilty to one charge of grossly indecent act at the Christies Beach Magistrate Court on Wednesday.

The court heard on August 10 of this year, Gardner’s neighbour had walked out to the front of her home when she also heard the elderly man quietly open his front door.

“She got the camera ready on her phone before she turned around quickly,” said the prosecutor.

“The defendant quickly removed his hands out of his trousers where his penis was exposed, poking out.”

The witness said a few words to the defendant and he “quickly scurried” back inside his house.

Police attended almost two weeks later to interview Graham who stated he did not recall exposing his penis tho his neighbour or masturbating in front of her.

“He admitted to having bladder issues and that sometimes he urinates outside when he is out in his yard,” said the prosecutor.

“A few days later when police spoke to him again he stated that he did in fact masturbate in his backyard, in view of his neighbours, but is unclear why he does it but that it is a weakness of his.”

Gardner’s defence counsel submitted to the court that he was not sure “what came over him” but had sought professional help since to gain insight to his offending as this was his second time partaking in such offence.

Magistrate Kylie Schulz place Gardner on a two-year good behaviour bond.

A conviction was recorded.
