David James Cabrera guilty of indecent behaviour after masturbating in Dan Murphy’s carpark

A gardener who was spotted half-naked committing an indecent act outside a popular bottle shop in view of children left shoppers shocked, a court has heard.

A woman was left horrified after witnessing a half-naked man masturbating outside of a popular bottle shop, a court has heard.

David James Cabrera pleaded guilty to indecent behaviour at the Christies Beach Magistrates Court after his December 27 arrest when he was found masturbating parked outside a Marion Dan Murphy’s.

“The witness was with her husband and they were parked in their vehicle at Westfield Marion,’’ the police prosecutor told the court.

“They sighted a male in his 60s wearing a dirty white T-shirt and was naked from the waist down, sitting upright in his seat, stroking his penis in an upwards motion.”

The court heard the witness was shocked by what she had seen, taking the licence plate of Cabrera’s white utility vehicle.

“She stated at the time she saw him masturbating in public with people going about their everyday business including children,” said the police prosecutor.

“Police attended the home of the defendant who stated he driven to Dan Murphy’s for some beer and made full admissions to masturbating.”

Cabrera’s lawyer said his client had been seeking support services due to alcoholism but had relapsed at the time of offending.

“The offending is linked to my client’s alcoholism,” he said.

“My client was reported by his general practitioner to transport SA which resulted in him losing his licence.

“The effect of him losing his licence has put a restriction on his job as a gardener.

“The alcohol links to an anxiety problem and a sentence of home detention may not assist with his rehabilitation.”

Magistrate Rodney Oates ordered a home detention report for Cabrera.

Cabrera will face court again in December.
