A 33-year-old man has faced court after allegedly stealing a car and seriously injuring a homeowner in the early hours of Sunday morning.
Daniel Gary Artis appeared in the Christies Beach Magistrate court on Monday, after he and five youths broke into a home on Frank Street, Marino.
The court heard the victim was laying on his couch around 4.30am on October 30, when he heard a noise at the back door.
“The victim looked and saw a male in a white baseball cap exit and slam the door shut,” the prosecutor told the court.
“The victim has given chase through the backyard round to the front where he has seen his wife’s car with the interior light on.”
The court heard the chase continued before Mr Artis allegedly entered a red hatchback.
“The victim ran between two cars in an attempt to get to the driver’s door, when Mr Artis drove forward and hit the victim and drove away,” the prosecutor said.
“As a result the victim has suffered a suspected left ankle fracture and a number of lacerations.”
It is also alleged a handbag was stolen from the property.
Patrols were quickly in the area and a short time later located the red hatchback, containing six occupants, Mr Artis and five youths, stationary at the entrance to the quarry off Lonsdale Road at O’Halloran Hill.
A search of the car located the stolen property which was returned to the owner.
Mr Artis was arrested and charged with a number of offences including serious criminal trespass and endangering life.
Mr Artis’ defence counsel made an application for bail
“He was seconded by this group of people,” he said. “He was in the wrong place at the wrong time.”
The court also heard Mr Artis had a warrant out for his arrest at the time of the alleged offence.
The front passenger, a 17-year-old boy from Huntfield Heights, was arrested and charged with aggravated serious criminal trespass and breach of bail.
Magistrate Briony Kennewell denied the bail application.
Mr Artis will appear in court again this year.
