Colm O’Hare denied bail a second time, charged with trafficking meth and fantasy

A father-of-five has lost his second bail bid after he was allegedly caught with $20,000, hundreds of grams of meth and fantasy and various weapons.

A father-of-five who was allegedly caught with large amounts of meth and fantasy has lost his second bail bid after he was deemed an “unacceptable risk” of reoffending.

Colm Patrick Francis O’Hare, 45, sought a review of bail in the Supreme Court on Monday, after being denied bail in the Adelaide Magistrates Court last month.

Brigid Symes, for the prosecution, said they were opposed to any form of bail, due to the strength of the prosecution case and Mr O’Hare’s risk of reoffending.

“Mr O’Hare was stopped by police after being observed to appear to be attempting to avoid police,” Ms Symes said.

The court heard police found 381g of methamphetamine, $20,000 in cash and 134g of GHB, also known as fantasy, in Mr O’Hare’s backpack on April 11 at Hackham.

Police then searched Mr O’Hare’s Hackham house.

“In the house, they found more GHB in two bottles, which together weighed over 500g,” Ms Symes said.

Police also found nine ice pipes, 25 tablets believed to contain pseudoephedrine, scales, 200g of dried marijuana and two tick lists.

Various weapons including a taser, a baton, a double-edged sword and ammunition were also found inside the house.

Ms Symes said Mr O’Hare was an “unacceptable risk” of reoffending as he had two prior convictions for drug trafficking.

Mr O’Hare is charged with multiple offences, including commercial drug trafficking and money laundering. He is yet to enter any pleas.

Chris McDonough, for Mr O’Hare, told the court his mother could offer $5000 cash surety for his release on bail.

Mr McDonough told the court last month while they agreed Mr O’Hare had recent relevant convictions, one had a strange background.

“It was not a straightforward case of trafficking in a controlled drug but rather bizarre circumstances where Mr O’Hare had stolen a car, found out who it belonged to and returned their car, being informed that it was full of drugs,” he said.

The court heard Mr O’Hare could work for a demolition company upon his release and he was the main carer for his young son.

Justice Adam Kimber denied Mr O’Hare bail, given the strength of the prosecution case and Mr O’Hare’s risk of reoffending.

“It appears clear that he has a longstanding problem with drug use,” he said.

“Drug use is notorious as a motivator for other offending.”

The charges were adjourned until September.
