SA government under fire over scathing child sex abuse report

Another man has pleaded guilty to filming himself sexually abusing a “very vulnerable” victim, who ended up taking her own life months later.

Allan Shane Dunn, 35, will be sentenced next week after he lied to police about the vile assault, telling them it was his girlfriend in the video.

Georgina Grosset, for the prosecution, told the District Court Dunn filmed the offending, and his DNA was located on a condom.

“The defendant denied engaging in sexual activity with the victim and also stated that the videos on his phone, time stamped that day, were actually him and his girlfriend,” she said.

The Whyalla father pleaded guilty to two counts of unlawful sexual intercourse and producing child exploitation material.

Sally Burgess, for Dunn, told the court her client now acknowledged the victim, who was under the Guardianship of the Minister at the time, was a particularly vulnerable child.

“However, he was not aware at the time as to those matters and, indeed, did not make an inquiry as to her age and he should have,” she said.

“His poor decision making on this occasion occurred whilst he was under the influence of amphetamine and he acknowledges that he had sexual intercourse with her to satisfy his sexual desire at that time.”

Auxiliary Judge Gordon Barrett asked why Dunn filmed the offending.

“I assume because he thought it was something to record, it was something that was exciting and he could look at it again,” Ms Burgess replied.

Cousins Jason Byron Burgoyne, 40, and Ralph Burgoyne, 45, were jailed earlier this year for sexually abusing the same victim.

During Jason’s sentencing earlier this month, the District Court heard his assault was captured in a Snapchat video filmed by Ralph, which a jury was forced to watch.

The court heard Ralph injected the victim with methamphetamine on December 15, 2021 and caused her to perform fellatio on him, which he filmed.

Later that day, the victim visited Jason’s Port Lincoln home and performed fellatio on him and Ralph, which he filmed again.

After a trial in the Port Augusta District Court in April, Jason was found guilty by a jury of unlawful sexual intercourse.

He was acquitted of another count, relating to sexual intercourse with the victim.

Ralph pleaded guilty to unlawful sexual intercourse and producing child exploitation material and was jailed for more than four years earlier this year.

Jason was sentenced to three years and three months jail, with a non-parole period of two years and three months.

Child Protection Department chief executive Jackie Bray told the Advertiser the victim’s tragic death has had devastating effects on her family, friends and the staff who cared for her.

“Children and young people in care often have experienced significant trauma and may be especially vulnerable to sexual abuse,” she said.

Ms Bray said the department was working to prevent the sexual exploitation of vulnerable young people.

This includes embedding Australia’s best practice model Mackillop Institute’s Power to Kids Program in its residential care homes, to improve children and young people’s awareness of respectful relationships, grooming, sexual development and sexual health.

“As a department, we treat concerns for our most vulnerable young people extremely seriously and provide them with a range of supports,” Ms Bray said.

“Supports are provided specific to the young person’s needs.”

Dunn will be sentenced next week.
