A former talented footballer has been jailed after he sexually abused a “very vulnerable” child, who ended up committing suicide months later.
Jason Byron Burgoyne’s vile assault was captured in a Snapchat video filmed by his cousin, which a jury was forced to watch.
During sentencing, the District Court heard the 15-year-old victim was with Jason’s cousin Ralph Burgoyne, 45, and another male on December 15, 2021.
The court heard Ralph injected the victim with methamphetamine and caused her to perform fellatio on him, which he filmed.
Later that day, the victim visited Jason’s Port Lincoln home and performed fellatio on him and Ralph, which he filmed again.
Data files from a Nokia phone were extracted by SA police in February 2022 which contained the incriminating Snapchat footage.
After a trial in the Port Augusta District Court in April, Jason, 40, was found guilty by a jury of unlawful sexual intercourse.
He was acquitted of another count, relating to sexual intercourse with the victim.
“As a consequence the court, including the jury, had to watch the film that Ralph Burgoyne had taken,” Auxiliary Judge Gordon Barrett said.
Auxiliary Judge Barrett said it was absolutely clear from the footage that Jason was aware the sexual abuse was being filmed, despite his counsel suggesting otherwise.
Ralph pleaded guilty to unlawful sexual intercourse and producing child exploitation material and was jailed for more than four years earlier this year.
The court heard the “very vulnerable” victim, who was under the Guardianship of the Minister, ended up committing suicide months later.
Auxiliary Judge Barrett said while there was no evidence Jason knew about the victim’s circumstances he had shown no remorse for sexually abusing her in the company of his cousin.
The court heard Jason was previously a successful semi-professional football player, playing in several states.
The court heard the father-of-three was alcohol and drug free and surrounded by positive influences during the years he played football.
“Your counsel submitted that when your successful football career came to an end your life ran off the rails and you began using alcohol and drugs and getting into trouble with the law,” Auxiliary Judge Barrett said.
Jason also pleaded guilty to multiple other charges, including assault and theft.
The court heard he spat in the face of a woman who rang police while he was stealing from Woolworths on December 9, 2021.
Auxiliary Judge Barrett sentenced Jason to three years and three months jail, with a non-parole period of two years and three months.
The sentence was backdated to November 2, 2022.
