Sean Thomas Davies witness tampering charge could be dropped

A man’s charge for making an alleged vicious threat to a witness, telling her to “drop the charges” or he would kill her, could be withdrawn, a court has heard.

The witness a man with a history of violent offending allegedly tracked down and said he would kill if she did not drop charges against him has become uncooperative, a court has heard.

Kidman Park man Sean Thomas Davies was on Thursday informed of the possible reprieve as a court heard negotiations indicated charges of serious criminal trespass and attempting to prevent a person from attending as a witness were likely to be withdrawn.

Those allegations meant Mr Davies was facing a possible 10 years behind bars if guilty and came as he faced a series of other charges against the same women, and two other people.

The first inkling the charges might be dropped was first heard in court last week when the matter was adjourned until Thursday for the prosecution to ensure that was the correct course of action.

But seven days later, with Mr Davies in prison at Yatala and his counsel hoping to have him released on home detention, a prosecutor told Magistrate Elizabeth Sheppard police were “no closer to knowing” if the charge would be dropped.

The prosecutor told the court the alleged victim’s “co-operation” coupled with the investigating officer being on leave had meant the discussions had not progressed.

Mr Davies, 31, first appeared in the Elizabeth Magistrates Court on the charges where a different prosecutor detailed the allegations.

The prosecutor told the court Mr Davies allegedly tracked down the address of a woman’s domestic violence safe house in Adelaide’s southern suburbs before pushing the door open and threatening to kill her.

“She’s heard a knock at the door … then saw Mr Davies who’s then come in and … got up in her face and whispered, ‘if you call anyone, if you tell anyone, I’ll kill you’,” the police prosecutor alleged Mr Davies said.

“(Mr Davies said) ‘Drop the charges otherwise if I go to jail I’ll get out and kill you’.”

While the two most serious charges were withdrawn, Mr Davis was still accused of a torrent of other alleged offences.

Those charges included assault causing harm, aggravated assault with a weapon, basic assault, twice damaging a car, damaging property and damaging a mobile phone.

The allegations stemmed from a period between late May and early July and involved Mr Davies, another man, and a woman he was in a short-term relationship with.

The court in July heard Mr Davies was on a suspended sentence, entered into in January, at the time of offending.

Mr Davies’s application for bail was rejected and he remained behind bars, where he had been since.

On Thursday Ms Sheppard ordered a home detention report for Mr Davies to a house at Davoren Park.

Mr Davies was remanded to again face court next week.
