A charge of aggravated assault levelled against a father-of-three has been dropped, but he will remain in prison on remand on unrelated charges.
Rodney David Clough, 40, of no fixed address but understood to be from the northern suburbs, on Tuesday appeared from remand in the Elizabeth Magistrates Court.
He was facing a charge of the aggravated assault of his former partner, but police withdrew the allegation.
Clough represented himself in court in August where he pleaded to see his children by Zoom call.
The application was not opposed.
He told the court that day he would be in prison on remand "until September or December".
The aggravated assault charge was alleged to have occurred in 2021, but Clough had not been remanded on it.
Clough next appeared on the charge early in October, represented by Elizabeth McDonald from Williams Legal.
Ms McDonald at that time foreshadowed the charges would likely be dropped.
“The complainant is not proceeding with the statement,” she told the court.
That suggestion was realised when police officially withdrew the charge.
Magistrate Brian Nitschke allowed the charges to be withdrawn.
