An alleged pervert has made the unusual move of being asked to be taken into custody after he failed to secure a plea deal on multiple child exploitation material charges.
Mathew Kayne Rutgers, 37, pleaded guilty in the District Court on Friday to seven basic counts of producing child exploitation material.
However, Lucy Hurley, for the prosecution, told the court the pleas weren’t accepted, as the charges were laid as aggravated offences.
An aggravated offence of producing child exploitation material means the defendant knew the victim was under the age of 14.
Court documents allege Rutgers produced child exploitation material between April 2021 and July 2022 in the northern suburbs.
Rutgers was also previously charged with multiple counts of indecent filming but they were withdrawn in July.
During Rutgers successful bail variation in March, the court heard he owned the St Agnes property he wanted to live at, where some of the indecent filming was alleged to have taken place.
“One (an alleged victim) was staying with me … she was there on a tourist visa,” Rutgers told the court.
“She’s not there anymore.”
Court documents alleged Mr Rutgers engaged in indecent filming of an adult without their consent multiple times between January 24 and December 26, 2021 at Plympton Park.
It was also alleged Mr Rutgers engaged in indecent filming of an adult without their consent multiple times between July 8 and October 2, 2022 at St Agnes.
Rutgers’ phone and laptop, which were seized after he was arrested by detectives from SAPOL’s Special Crime Investigation Section on December 4.
On Friday, Patrick Dawes, for Rutgers, told the court his client had instructed him to apply to the court to revoke his bail.
“He wishes to start serving the sentence of imprisonment that will be imposed from today,” he said.
Judge Nick Alexandrides revoked Rutgers’ bail and remanded him in custody.
Rutgers will now face trial for the charges in October next year.
