A man who is accused of indecently filming people over 18 months will be allowed to return to the home where some of the alleged offending occurred.

Mathew Kayne Rutgers, 37, appeared in the Adelaide Magistrates Court on Tuesday, applying to have his home detention address varied so he could move back to Adelaide.

The court heard Mr Rutgers, who is facing 25 counts of indecent filming, had been living in Port Pirie since his release on bail.

A prosecutor said they were opposed to the bail variation for the safety of the alleged victims – with one living 5km away from Mr Rutgers’ proposed address.

The court heard Mr Rutgers owned the St Agnes property he wanted to live at, which is where some of the indecent filming is alleged to have taken place.

“One (an alleged victim) was staying with me … she was there on a tourist visa,” Mr Rutgers told the court.

“She’s not there anymore.”

Court documents allege Mr Rutgers engaged in indecent filming of an adult without their consent multiple times between January 24 and December 26, 2021 at Plympton Park.

It is also alleged Mr Rutgers engaged in indecent filming of an adult without their consent multiple times between July 8 and October 2, 2022 at St Agnes.

Indecent filming is defined as filming another person in a state of undress or in a private act in which a reasonable person would expect to be afforded privacy.

The court previously heard prosecution needed more time to review Mr Rutgers’ phone and laptop, which were seized after he was arrested by detectives from SAPOL’s Special Crime Investigation Section on December 4.

Magistrate Justin Wickens granted Mr Rutgers’ bail variation.

“He’s on home d, so we know where he is within three feet anywhere on the earth,” he said.

Mr Rutgers will face court again later this month.
