A Paralowie man on bail for “serious” allegations cut off his monitoring device, spent eight days on the run before turning himself into police, a court has heard.
David Champion, 39, appeared via videolink at the Elizabeth Magistrates Court on Monday charged with breaching bail twice while on home detention for an alleged aggravated assault causing harm.
Police asking for Champion’s bail to be revoked with Magistrate Yoong Fee Chin saying he had cut off the bracelet and left his nominated address on November 27, remaining wanted for until handing himself in on Saturday.
Duty solicitor Omar Ali said Champion did cut off his bracelet but did because he was worried about his partner’s safety, who had recently entered South Australia from interstate.
“I do understand that home detention is a bail of last resort but there was a report released recently which outlined that he was compliant before this one occasion,” Mr Ali said.
“He was offered employment most recently, but due to the long hours, DCS [Department of Correctional Services] was unwilling to give him pass outs [from home detention] for such long amounts of time.”
Mr Ali said Champion was currently taking medication for clinically diagnosed anxiety and financially supported his 14 year old daughter.
He asked Mr Chin for an adjournment for Champion to confirm a suitable home detention bail address
The police prosecutor opposed any form of bail.
“He’s shown he only adheres to the conditions of last resort when it suits him seemingly your honour, he cuts his bracelet off when he wants to do something else and he’s at large for as long as he deems it convenient to himself,” they said.
“It’s a very serious charge in relation to the allegation he’s committed assault which has caused harm, the complainant has been spoken to, she confirms it and wants to pursue it.
“An interview and body worn footage has been disclosed to the defence council and medical notes are being prepared.
“This defendant has shown no will to adhere to provisions imposed by the court, he’s been offered the last chance and simply hasn’t taken it.”
Magistrate Chin said he was only prepared to consider home detention bail and ordered a report.
