A young man’s response to a woman complaining about noise from excessive burnouts was to pull down his pants and show his buttocks, a court heard.

Dillion James Christian, 20, dodged a conviction for his “impulsive, immature prank” where he also threatened to plough up the elderly lady’s lawn.

During sentencing, the District Court heard a trail bike was being ridden up and down the street and performing burnouts on February 1, 2021.

The court heard Christian, who was 18 at the time, and other people were outside watching the bike, with the noise continuing into the afternoon.

After the bike conducted a burnout on the verge out the front of the victim’s house around 8pm, she went outside to complain.

“The background to her complaint was that this type of noise disturbance from a trail bike rider happened frequently,” Judge Michelle Sutcliffe said.

Christian walked over to the victim.

“You stepped back towards the road, and you pulled your pants down, exposing your buttocks to her, and you spread your buttocks to show your anus,” Judge Sutcliffe said.

The court heard Christian’s offending was photographed by the victim’s husband.

“At some point in this interaction, you yelled at (the victim), swore at her, and said words to the effect that you would get a mate to come back and plough up her front lawn.”

Christian, of, Elizabeth Grove, pleaded guilty to indecent behaviour.

The court heard Christian lost his father as a young child, before also losing his stepfather in tragic circumstances.

“You ran into some trouble and abused alcohol,” Judge Sutcliffe said.

The court heard Christian was currently unemployed but was looking for work and had a forklift licence.

The court heard Christian had since “pulled his head in” and reflected on his behaviour, which he was not proud of.

Judge Sutcliffe said people were entitled to be free from harassment in their own streets.

“Your conduct was an impulsive, immature prank at the expense of a woman who was in her 70s,” she said.

“Your response to her complaint about the noise in the street was to humiliate her by acting indecently.

“It is clear to me that you thought you were being funny. It was attention-seeking and immature, but unfortunately, it also amounted to intimidating behaviour.”

Due to Christian’s young age, Judge Sutcliffe opted not to record a conviction and instead imposed a 12-month good behaviour bond.

She also ordered Christian to complete 15 hours of community service.
