A 30-year-old man who allegedly supplied a child with free drugs then performed sex acts on her has been bailed to live with a four-year-old child.
David John Wakeling was in the Adelaide Magistrates Court on Tuesday granted home detention bail, contesting any predatory acts occurred.
The court previously heard a 19-year-old witness – who had been dating the 16-year-old victim – met Mr Wakeling online a few months prior.
“There were two prior occasions where the defendant attended at his home address and provided him with free drugs in exchange for sex acts,” the prosecutor said.
The court heard the witness was at home on November 19 when he messaged Mr Wakeling asking if he had weed, but Mr Wakeling replied he only had juice, known as fantasy.
“The victim then started messaging the defendant on the witness’s phone and agreed to certain sex acts in exchange for gear – the sex acts were for the defendant to shave the victim’s vagina then perform oral sex on her,” the prosecutor said.
The court heard Mr Wakeling attended the Klemzig house and allegedly provided fantasy to the witness and the alleged victim.
The court heard the witness allegedly saw Mr Wakeling shave his girlfriend’s vagina but passed out before the oral sex was performed.
The witness messaged Mr Wakeling about the allegations and told him they were going to report him to police.
The witness told police Mr Wakeling knew the alleged victim’s age as it had come up in conversation.
Mr Wakeling, of Medindie, is charged with unlawful sexual intercourse and selling a controlled drug to a child.
Sarah Graham, for Mr Wakeling, told the Adelaide Magistrates Court on Tuesday he would be contesting the charges.
Ms Graham said while the home detention report raised that a four-year-old child resided at the address, Mr Wakeling had no prior history of child sex offending.
“The alleged victim in these allegations is a 16-year-old in a relationship with a 19-year-old,” she said.
“I understand that the mother of the child is aware of the allegations and has no concerns that Mr Wakeling will be residing with her and her child.”
Magistrate John Wells granted Mr Wakeling home detention bail, with conditions not to contact the alleged victim or witness.
He reminded Mr Wakeling to comply with all bail conditions or the chances of him being granted bail again would be zero.
The charges were adjourned until March.
