A company linked to the owner of a popular Adelaide Hills face and wedding venue is facing liquidation over an unpaid debt.
Pooraka-based fruit and wholesaler AMJ Produce has filed winding-up proceedings against Hahndorf food identity Silvia Hart’s firm Maerhuev Pty Ltd, alleging she has ignored a court order to pay a $55,000 produce bill.
According to Federal Court documents, filed by AMJ Produce, Maerhuev traded as The Seasonal Garden Cafe and Store with a principal place of business at 100 Main Rd, Hahndorf.
That address is the location of the current Seasonal Garden Cafe.
ASIC business register shows that The Seasonal Garden Cafe and Store business name was deregistered on February 20, 2017.
Ms Hart is the sole director and shareholder of Maerhuev. She does not have any other companies under her control, according to a search of the ASIC database.
AMJ Produce secured a judgment debt against Maerhuev on May 2 this year and launched a winding-up application after Ms Hart failed to comply with a statutory demand requiring she pay the $55,000 within 21 days of the court order.
A hearing on the winding-up order is slated for July 24. If the application is granted it will likely trigger the liquidation of Ms Hart’s company.
Ms Hart declined to comment publicly if any liquidation of Maerhuev would have an impact on the Hahndorf business.
Ms Hart registered the business name The Seasonal Garden Cafe in February this year.
On April 24 her partner Dewisri Bruyn registered the business name Seasonal Garden Cafe Hahndorf.
The Advertiser revealed in January that AMJ Produce had sued Ms Hart for failing to pay a $100,000 fruit and vegetable bill.
At the time Ms Hart said she did not dispute owing money but had disputed the amount AMJ Produce claimed was unpaid.
The Seasonal Garden said on a July 5 Facebook post that it was almost fully booked for the 2019/20 wedding season.
Ms Hart, who was recognised by Primary Industries and Resources SA as a Food Ambassador for her sustainable ethos, expanded her business to include another Hahndorf outlet and branches in Stirling and Norwood.
She sold the Norwood branch this year and her daughter took over ownership and management of the Stirling branch and changed the name.
