Dylan Pedler sentenced for serious criminal trespass and assault at Whyalla

A father came close to missing the birth of his second child after feeling a “rush of blood” during a spontaneous assault and home invasion.

The Adelaide District Court on Wednesday heard Dylan Pedler, 29, and two other men attended a Whyalla Playford property on April 5, 2020.

When the homeowner opened the door, Pedler said “why you causing s**t?”

Pedler then stepped inside the front door and started pushing the victim backwards before punching him.

“You then grabbed (the victim) by his shirt with both hands and shook him a few times,”

Judge Paul Slattery said during sentencing.

“You then said something to the effect ‘control your b***h, stop causing s**t’.”

The victim tried to usher Pedler out of the house but he jabbed him twice to his cheek.

Pedler, of Whyalla Norrie, pleaded guilty to assault and serious criminal trespass.

The court heard the victim didn’t suffer any injuries.

Matthew Christey, for Pedler, previously told the court he had no intention to break in and assault anyone when he went to the house.

“The decision by Mr Pedler to conduct himself in this manner was a spontaneous, obviously very stupid … decision out of fear that Mr Pedler was going to lose his life partner,” he said.

“Everything happened at the front door and it could be described really as a rush of blood by Mr Pedler when it was (the victim) that in fact answered the door.”

The court heard Pedler had a young child, with another one on the way and he had written a letter of apology to the victim.

The court heard Pedler was working as a concreter.

Judge Slattery sentenced Pedler to three years and seven months, with a non-parole period of 24 months.

“You have put members of your community in an undoubtedly frightening and violent situation and you did this by forcing your way into their home,” he said.

“Individuals deserve the right to feel safe in their homes.”

Due to Pedler’s remorse and low risk of reoffending, the sentence was suspended on a $1000, three-year good behaviour bond, with supervision for two years.
