Daniel Johannes van Sittert pleaded guilty to driving without due care in Alford fatal crash

A man had a win in court after his more serious charge was dropped but admitted to driving carelessly to cause the death of another driver on the Yorke Peninsula.

A man had a win in court and admitted to driving carelessly in a horror crash on the Yorke Peninsula.

Daniel Johannes van Sittert, 31, of Willamulka, pleaded guilty in the Adelaide Magistrates Court on Thursday to aggravated driving without due care, causing the death of a person.

The court heard the plea was accepted by prosecution in satisfaction of the alternative charge of causing death by dangerous driving.

Police were called to Bews Rd at Alford about 8am on March 7 after reports of a multi-vehicle crash involving two Mitsubishi utes.

As a result, the other driver, a 74-year-old man from Kadina, was killed and van Sittert was taken to the Wallaroo Hospital with non-life-threatening injuries.

Bews Rd and Haldanes Rd were closed at the intersection of Hewetts Rd and Axford Rd while Major Crash officers examined the scene.

Under current SA law, the only charge to which causing death by dangerous driving can be downgraded is an aggravated count of driving without due care.

Instead of facing a maximum 15-year prison term and mandatory minimum 10-year licence disqualification, offenders face 12 months’ jail and a six-month disqualification.

The accepted plea to the lesser charge means the matter will be finalised in the Magistrates Court jurisdiction instead of being committed to the District Court.

On Thursday, van Sittert’s charge was adjourned until November for sentencing submissions.
