Bikies in Australia- A short history

A man is remorseful for his role in a violent robbery where a man was seriously injured in a bid to repay a bikie’s debt.

Damian Anthony Green, 42, was jailed in the Adelaide District Court last month for his involvement in the terrifying home invasion.

The court heard at least three men and one woman forcefully entered a Two Wells home on September 8, 2017.

A man and a woman were inside.

“One of the male offenders either used or threatened to use a taser against (the man) causing him to fall backwards and onto his bedroom floor,” Judge Jane Schammer said during sentencing.

“(The man) was then punched to the face and kicked and struck multiple times.

“His hands were tied behind his back using electrical tape and he was forced to lie facedown on the loungeroom floor.”

The court heard one of the men threatened to kill (the man) if he moved.

“That offender jabbed (the man) in the back with (the man’s) baseball bat and held a knife to the back of his neck while other offenders ransacked the house and others searched sheds on the property, looking for money, keys and vehicles to steal,” Judge Schammer said.

“While (the man) was bound and lying on the loungeroom floor, a male offender sat on his back while another male offender stood over him, such that he was detained and prevented from moving from this position for around 45 minutes.”

The court heard the woman was also forced to lie on the loungeroom floor but wasn’t tied up or assaulted.

The man suffered a concussion, a fractured nose, damage to his eye socket and multiple lacerations.

The group stole three cars, three motorbikes, a trailer, money and electronic devices.

Green, of Cobdogla, was found guilty in trial of multiple charges, including false imprisonment and assault causing harm.

The court heard Stuart James O’Neill, 35, of Freeling gave evidence at Green’s trial and said Green stayed in the car while he and others entered the home.

“You also assisted to load three motorbikes into a trailer, you then accompanied O’Neill in one of the stolen vehicles,” Judge Schammer said.

In September 2017, O’Neill had just left the Mongols but still owed $18,000 in drug money to the gang’s national sergeant at the time, known only as AM.

AM’s sister urged O’Neill to participate in a violent break-in so he could pay back some of the debt.

O’Neill, who is a former member of both the Gypsy Joker and Mongols motorcycle clubs, was sentenced to nine years and five months – with a non-parole period of five years – for the home invasion and other unrelated crimes.

Isaac Giordimania, 38, of Salisbury Downs and Benjamin McCann, 36, of Smithfield have also been sentenced for their involvement.

Co-offenders, Rebecca Lynda Majchrak, 34, of Hillbank and Wendy Anne Paget, 49, of Adelaide were found guilty in trial and will be sentenced at a later date.

The court heard both victims were left traumatised by the incident, particularly the man.

“He has installed metal bars on both his front door and bedroom door and locks himself in his room at night,” Judge Schammer said.

The court heard Green – who operates the Riverland landscaping business, Green Thumbs with his partner – was remorseful for his offending.

Judge Schammer sentenced Green to three years and two months jail, with a non-parole period of one year.

The sentence was backdated to February 25.
