Kane Robert Mitchell jailed for sexually abusing 13-year-old girl

A vile sex offender ripped a family apart after he used manipulation, alcohol and drugs to control a child and isolate her from her friends and family.

A predator ripped a family apart after he sexually abused a 13-year-old girl multiple times, including at a school and cemetery.

Kane Robert Mitchell, 21, used manipulation, alcohol and drugs to prey on the child and isolate her from her friends and family.

During sentencing, the District Court heard Mitchell met the victim at the home of someone they both knew.

Despite the victim telling Mitchell she was 13 he began sexually abusing her, including an incident in the garden of a school.

“You had intercourse once in a cemetery and at a greyhound track,” Judge Michael Durrant said.

The court heard Mitchell picked up the victim from school in December and gave her alcohol to drink before sexually abusing her in disabled toilets.

“You threw her phone out of the window while driving as she had told you that her parents were able to track her location,” Judge Durrant said.

Mitchell, of Avoca Dell, pleaded guilty to maintaining an unlawful sexual relationship with a child.

The victim and her mother both read a victim impact statement in court.

The victim said she changed from a regular happy 13-year-old girl to someone who became detached to the world around her.

The court heard the victim’s family relationships deteriorated and she became reliant on drugs.

“She told me she stole from her own family to support you,” Judge Durrant said.

“Her family ceased to trust her.”

The victim’s mother told the court Mitchell was cunning and he feigned ignorance about her daughter’s whereabouts when she was with him.

“She told me about how distressed it made her to reflect on the level of control you had over her daughter and your use of drugs as a tool to manipulate her,” Judge Durrant said.

The victim’s father wrote that due to Mitchell’s offending he now feels numb, sickened and lost as a parent.

“His health has declined and he feels powerless in not being able to have protected his daughter from you,” Judge Durrant said.

Judge Durrant said he did not accept the submission that Mitchell was not a predator but rather an opportunistic offender.

“The consistent and repeated nature of your offending over the period indicates much more than opportunism,” he said.

“You isolated your victim both physically and emotionally from her friends and family.

“You used manipulation, deceit, alcohol and drugs.”

Adding onto a sentence Mitchell was already serving, Judge Durrant jailed him eight years and three months’ jail, with a non-parole period of four years and three months.
