Betros Brothers named in $753k negligent driving lawsuit

A moped rider is suing a much-loved family business after one of its delivery drivers allegedly caused a traffic crash that destroyed her knee.

A Betros Brothers driver is facing a $750,000 lawsuit after he allegedly caused a traffic crash that destroyed a woman’s knee.

According to a claim filed in the Toowoomba Supreme Court, Monica Diggins was riding her Moped scooter though the roundabout at the intersection of Alderley and Ramsay Streets on August 8, 2022 when she was hit by a Hino Ranger truck that was owned by Betros Brothers.

The claim alleges that the truck was being driven by Roger Dunbas Mayes and that the crash was the result of his negligence.

Betros Brothers is a long standing Toowoomba grocer and food wholesaler that opened its doors in 1938.

It runs a retail supermarket in Russell Street and a wholesale warehouse in Annand Street, both in the Toowoomba CBD.

As a consequence of the crash, Ms Diggins claims she suffered multiple injuries, including a serious leg injury that required a total knee replacement to repair.

The claim alleges Ms Diggins has experienced ongoing pain while walking and standing, that she now requires assistance from friends and family to undertake the task of daily life and can no longer ride her Moped scooter.

Acting on Ms Diggins’ behalf, Recover Legal filed an injury claim naming Mr Rogers as the defendant, along with Betros Bros and the company’s insurer AAI Limited.

The damages sought total $753,000, of which $256,000 relates to the cost of future care and assistance, $216,000 is for future economic loss, $74,000 is for Ms Diggins’ pain and suffering and $70,000 is for lost past earnings.

The defendants had not filed a defence by the time of publication.
