Nirrorn Labour Pride Pty Ltd fined by Labour Hire Authority

A horticulture labour hire company and its director have been fined $287,500 for multiple breaches of Victoria’s Labour Hire Licensing Act.

A horticulture labour hire company and its director have been fined $287,500 for multiple breaches of Victoria’s Labour Hire Licensing Act 2018.

The Supreme Court of Victoria found Nirrorn Labour Pride Pty Ltd had failed to notify the Labour Hire Authority of numerous changes in company directors; and that a director was no longer a fit and proper person.

The court found company director Sokheng Seng had falsely declared he had not been involved in another labour hire services business when he submitted a labour hire licence application. He had in fact been an officer of labour hire company Monorom Labours Power Pty Ltd.

Monorom’s labour hire licence was previously cancelled by LHA, meaning Seng was no longer considered a fit and proper person.

The court also found that Nirrorn had made multiple company director changes without notifying the LHA in 2022 and 2023.

In total, Nirrorn was fined $230,000, and Mr Seng penalised $57,500 for the breaches.

In September 2024, Monorom had been found to have committed similar contraventions of the Act, fined $220,104, and two directors fined $43,784.

Labour Hire Licensing commissioner Steve Dargavel said labour hire workers in the horticulture industry were “among Victoria’s most vulnerable”.

“Ensuring we have fit and proper people running Victorian labour hire companies is an important way of protecting workers and improving the industry’s integrity.”
