A “JEALOUS” and violent Hobart lawyer who assaulted his police officer partner and her ex-lover has been sentenced.

In August, Daniel John Bearman, 44, was found guilty in the Hobart Magistrates Court of three counts of common assault, one count of destroying property and one breach of a police family violence order.

But he was also acquitted by Deputy Chief Magistrate Michael Daly of another count of common assault, two counts of trespass and four other family violence order breaches.

In his published decision earlier this year, Mr Daly said Bearman emerged from the bedroom of his partner – a Tasmania Police physical surveillance officer – during August 2017 to discover her ex-lover had arrived.

He said “who the f..k are you?” to the man before Bearman punched him about six times to the hands and forearms and spat at him twice.

Bearman was also found guilty of destroying his partner’s iPhone.

Mr Daly said the pair’s relationship went “underground” until they officially broke up on New Year’s Day 2018.

Describing the relationship as dysfunctional, Mr Daly found Bearman guilty of two counts of assault against the woman on January 2, 2018 — by grabbing her throat and squeezing on two occasions and pushing her, and by raising his fist and moving it towards her face in a threatening manner.

Mr Daly said in sentencing on Wednesday that a pre-sentence report had found Bearman had not expressed any remorse or empathy and he felt justified in his actions.

He said the report also indicated Bearman had said the relationship was strained from the start as he thought his partner was having an affair.

Mr Daly said grabbing someone by the throat was inherently dangerous and was an “exercise of power and control.”

He said it was an aggravating factor the assaults had taken place in the woman’s home when her children were in the house.

“I fear you may commit family violence in the future due to your jealousy and anger [issues],” Mr Daly said.

“The sentence I impose must make it clear the consequences of any repeated family violence must be imprisonment.”

Bearman was convicted and sentenced to three months in prison, wholly suspended.

He will be subject to a community corrections order for 12 months as part of which he must complete a family violence offender intervention program.
