Luke Temby: Junior soccer coach, software programmer guilty of child sex videos, filming upskirts

A Hobart software programmer and long-term club soccer player who coached his son’s junior team possessed thousands of child sex videos and images, and filmed upskirts on the Tasman Peninsula.

A software programmer and long-term club soccer player who coached his son’s team possessed thousands of child sex videos and images, and filmed upskirts on the Tasman Peninsula, a court has heard.

Hobart man Luke Christopher Joseph Temby, 40, understood to live in the Clarence municipality, previously pleaded guilty to a charge of possessing child exploitation material and a charge of possessing prohibited visual recordings.

He was sentenced by Supreme Court Chief Justice Alan Blow on December 7 to a 12-month community correction order, conditional upon him performing 100 hours of community service.

On May 17 last year, police officers conducted a search at Mr Temby’s home, looking for child exploitation material, Chief Justice Blow told the court.

On his computer they found a total of 1967 images and videos that constituted child exploitation material, hundreds of which depicted pre-pubescent children engaged in sex acts, some of them incredibly degrading.

The material had been sorted into folders but there was no evidence of them having been distributed further, Chief Justice Blow said.

The material was on a computer in a part of Temby’s residence accessible by his wife and two adolescent children and there was “some risk of accidental exposure to the images and videos,” although there was no evidence of this actually occurring.

The prohibited visual recordings charge related to four videos recorded by Temby at the Fortescue Bay Camping Ground on the Tasman Peninsula.

Temby recorded four people getting changed, using the toilet, and showering.

“None of the people would have been aware that recording was in progress. They were filmed from below the groin area, with the camera pointing upwards,” Chief Justice Blow said.

Temby had “consistently maintained that he had no sexual interest in children, except that he had a curiosity about young female development”.

“He reportedly kept the files out of curiosity and because of the thrill of doing something bad,” Chief Justice Blow said.

“He reportedly filmed the people at the Fortescue camping ground because of the thrill of doing something bad, and not for the purpose of watching the footage.

“Having read the psychologist’s report, I have no reason to disbelieve his assertions as to his motives.”

The court heard Temby had ceased watching pornography – which he had watched “habitually” in the years before his offending was detected – and had begun spending more time with his wife in a bid to repair their relationship, which had been strained by his charges.

Chief Justice Blow said the convictions would “likely... interfere with his career” as a software programmer. Temby works at a Hobart-based technology firm.

Temby had also ceased coaching his son’s junior soccer team and given up playing the sport himself, the court heard.
