The son of a well-known outback Qld family will walk free from jail where he has remained since he was found guilty of rape last year after a successful appeal overturned his convictions.

A well-known Mount Isa man who was found guilty of rape during a trial last year will walk free as he awaits a new court date.

Daniel Giuseppe Grimaldi was found guilty on three counts of rape following a trial in the Townsville District Court last year.

A recent appeal to overturn those convictions was successful after barrister Jeff Hunter KC argued there had been a miscarriage of justice and the jury’s verdict were unreasonable.

The Queensland Court of Appeal upheld the appeal and ordered a new trial on those counts.

In Townsville Supreme Court on Friday, defence barrister Claire Grant, instructed by Anderson Telford Lawyers, submitted an application from bail which was unopposed by the crown.

Grimaldi did not appear in court.

Justice David North said there had been an “outbreak of co-operation and agreement” between the parties.

The application took only two minutes before Justice North said he was satisfied that bail should be granted.

Grimaldi denies the allegations.

A new trial will be ordered for Grimaldi who will face three charges of rape.
