A man accused of shooting and killing three people has had his trial date terminated as he changed lawyers for a fifth time.
On Thursday morning, Darryl Valroy Young appeared by way of audio link at the Townsville Supreme Court as his new legal representatives from Legal Aid Queensland asked to adjourn the case.
Mr Young is alleged to have gunned down Mervyn and Maree Schwarz and Maree’s son Graham Tighe on August 4, 2022 at the fence line between their rural cattle properties west of Bowen.
He has been charged with three counts of murder and one count of attempted murder.
No pleas have been entered.
Solicitor Rosemary Varley from Legal Aid Mackay asked to withdraw from the case.
Barrister Gregory McGuire who appeared by phone said he was “obviously” going to submit “an application to adjourn the trial” and that he wasn’t confident the two weeks set aside for the proceedings would be long enough.
“My instructing solicitor in Townsville has been dealt the cards she has, we’re not going to be in a position to properly defend Mr Young at the trial listing,” he said.
Mr McGuire suggested a listing in six weeks to review the trial again.
Justice David North officially vacated the trial listing that were originally set for July 14 and adjourned the case to July 21 for mention only.
The vacated trial comes three years after the alleged murder shocked Queensland, and after Mr Young had already parted ways with four other lawyers.
He was denied bail earlier this year in the Supreme Court after His Honour labelled him an “unacceptable risk” of flight and commiting an offence.
