A 53-year-old who was jailed in the 90s is back in prison after being caught with child exploitation material.

Troy Leigh Cracknell pleaded guilty to one count of possessing child abuse material accessed using a carriage service after police raided his house in Glenorchy on February 20, 2024.

He had 2139 photos and 227 videos of child abuse material across five mobile phones.

Cracknell had previously been convicted of child sexual abuse offences in 1998.

In regards to the child exploitation material he downloaded between January 2021 and February 2024, Acting Justice Porter said Cracknell had expressed remorse over his actions.

“He knew what he was doing was criminally and morally wrong and is greatly ashamed of his behaviour.

“I was told that being arrested and charged has been a significant shock for him.

“I was told that he has full insight into the issues surrounding child abuse material and clearly recognises the criminality involved.”

Justice David Porter Advised that the modern convention is for Judges to be robed when sitting in both the criminal and civil jurisdiction, but to wear a wig only when sitting in the criminal jurisdiction. Accordingly, two photos of each Judge are published in the website gallery;

Justice Porter said accessing and possessing child exploitation material was not a victimless crime.

“The production of such material involves the exploitation and abuse of children somewhere in the world.

“The damage done is often profound.

“Possession and viewing exacerbates and extends the abuse and exploitation. Access and possession tend to create a demand for its production.

“Viewing can have the effect of normalising the depicted conduct and desensitising the viewer.”

Justice Porter said the deterrence of others from similar conduct and condemnation were “paramount considerations” when sentencing.

“In terms of this offending, the number of images is significant, although not anywhere near as large as some cases that come before the courts.

“I accept that there is an absence of some factors which, although not mitigatory, often aggravate this type of offending.

“There is no distribution or sharing, or financial gain. The material was not paid for.”

Cracknell was sentenced to four years and nine months in jail.

Once released from prison, he will be on the sex offenders list for 15 years.
