Hobart City councillor Louise Elliot will return to the council after serving 16 days of a 30 day suspension, which she received over a code of conduct finding.

Ms Elliot was suspended last month after a complaint was made, but the exact details of the appeal have been kept confidential because Ms Elliot filed an appeal with the Hobart Magistrates Court,

Ms Elliot appeared in the Hobart Magistrates Court on Tuesday for her appeal and was granted a stay.

It means for now her suspension is on hold until the outcome of her appeal.

“I’m back with the councillor title after I applied at the Magistrates circuit yesterday afternoon for a stay on the suspension I’ve been imposed as a result of a code of conduct complaint,” Ms Elliot said in a video update on social media.

“That suspension has been lifted.”

Ms Elliot was set to miss two council meetings as a result of her suspension, but she only missed one.

She said she’s filed the appeal “on the grounds of natural justice not being applied fairly”.

“This is a very unjust situation whereby I was suspended, and this was announced by the Lord Mayor, even though the decision is being reviewed and the suspension could very well be overturned,” Ms Elliot told the Mercury on Wednesday.

“This situation should not have occurred and highlights obvious gaps in legislation, a lack of foresight, and disregard of procedural fairness toward me.”

Ms Elliot said the next hearing for her appeal would be in March.

Meanwhile Ms Elliot said she plans to take the council to the tribunal after she was allegedly blocked from making a booking at Town Hall.

Ms Elliot, who has frequently spoken out against transgender women being in women spaces, said her event was a women’s rights event.

“I’m taking the Hobart City Council to the discrimination tribunal, we have a conciliation date set for later this month and I suspect it will be like that it will go to a hearing,” she said.
