An alleged Comanchero bikie and two others may have got the wrong man when they allegedly kidnapped a victim from Huntfield Heights shops, a court has heard.

Jye Benn Bone, 20, previously alleged to be a Comanchero member, was granted home detention bail at the Christies Beach Magistrates on Thursday.

During the hearing, prosecution said Mr Bone and two other men allegedly told the victim to get into a vehicle on Honeypot Rd at Huntfield Heights earlier this month.

“The defendants drove him around before stating something similar to ‘we’ve got the wrong guy’, pulling over on Sports Park Dr at Morphett Vale,” prosecution said.

Mr Bone and his two co-accused allegedly then assaulted the victim by punching him to the head and body.

The court heard the victim suffered a broken jaw, three broken teeth, a broken nose and soreness to his throat from being choked. His phone was also stolen during the incident.

Prosecution said the victim knew two of the men but the defendant was not one of them.

A witness reportedly saw a person on the ground being punched by others and obtained the registration number of the vehicle.

Police later located the vehicle travelling north on the southern expressway, with the defendant driving the car on his own.

They also suspect the defendant was wearing clothing that contained blood.

Prosecution said ongoing investigation “believe this blood belongs to the defendant” who declined to answer questions on the matter.

Mr Bone has been charged with detaining a person to commit an indictable offence, committing an assault that causes harm and theft.

A lawyer for Mr Bone said the charges against him were “firmly contested”.

“My submission is that there are some potential concerns raised about how strong this case may end up being,” she said.

She asked Magistrate Kylie Schulz to take that into account, along with other factors, including Mr Bone’s young age and a co-accused being granted bail when considering her client’s bail application.

She said prosecution were not alleging a significant history, which the court heard included an earlier case of failing to comply with bail.

Prior to being remanded in custody Mr Bone had work concreting, his lawyer said.

Defence added that Mr Bone’s mental health has been impacted by the suicide of an ex-partner and he has been struggling, including in custody.

Magistrate Schulz granted him bail on several conditions, including no contact with his two co-accused and the victim.

Mr Bone will return to court in September.
