‘Just f---ing shoot me’: Armed man confronts police at cop shop

A father of four stands inside a police station gripping a hammer repeatedly yelling at police to “just f---ing shoot me”.

Officers, with tasers drawn, are trying to defuse the heated standoff.

Shocking police bodycam footage, released to this publication, shows a confronting example of what police face on any given day.

“Just shoot me … I’m f---cking over it,” the man screams.

“Don’t come towards us, you may be shot,” an officer warns, repeatedly telling the man to “put the hammer down”.

“F---ing kill me please,” he yells.

“We don’t want to do that mate,” an officer says. “Let’s just have a chat.”

Several times the man inches closer to an officer and is warned to stay back and drop the hammer

“You need to drop that so we can sort this out,” the officer says.

‘Could have ended disastrously’

The stand off on March 8, 2024 lasted about two minutes before an officer fired his taser on Timothy Mervyn Charles Hart, who fell to the ground screaming and was placed in handcuffs.

At no point did any officer wield their guns.

“I thought they showed incredible patience and resilience when dealing with you,” Acting Magistrate Nigel Rees said.

“They did not draw their firearm.

“This could have ended disastrously for you and your family.

“Police officers are entitled to go about their duties without being threatened.”

Hart had just learned there was a warrant out for his arrest and been handing himself into police when the explosive confrontation occurred – he had just learned he would be going back to jail.

Mackay Magistrates Court heard the 34-year-old had been on parole since 2021 but with just 12 days left had been breached because he had started a new relationship and had not informed his parole supervisors about that as is required, and as a result a return to prison warrant was issued.

This wasn’t made clear when he walked into the Mackay police station on Sydney St because the officers didn’t know why he was breached, just that he had to be arrested.

Mr Rees levied no criticism at police, but said “communication between the different departments might have avoided what happened next”.

When Hart was told he would be arrested he pulled a hammer from his shorts.

‘My life’s ruined’

The court heard Hart had an “atrocious” criminal history, but Legal Aid Queensland solicitor Danny Yarrow said there had been a gap in his offending since being on parole and in that time his client had found work as a hydroblaster, accommodation and had gotten clean from drugs.

“My life’s ruined,” Hart said to police – his job, home would be lost if he went back into custody – as he repeated, “Shoot me man, just f---king kill me, I’m done.”

He thought “everything that he’s worked for has been lost”, Mr Rees accepted, as he balanced all the facts.

Mr Yarrow argued that at no point did Hart raise the hammer and also commended the officers involved for not drawing their firearms during the incident.

“He’s armed with it though (and) asked multiple times to drop it,” Mr Rees said, further asking, “Why’s he got a hammer on him?”

A reason could not be provided.

The court heard Hart’s job was waiting for him once he was released, having spent 314 days in presentence custody.

“You’ve got your life back on track and your behaviour at the police station manifested because you thought you were going to lose everything,” Mr Rees accepted.

Hart pleaded guilty to serious obstruction while armed and given immediate parole release with the 314 days declared as time already served.
