Byron Bay: Bradley McGettigan accused of stalking, intimate image sharing

A Byron Bay concreter and volunteer firefighter with “strong community ties” already on bail for domestic violence charges allegedly reoffended within days of an AVO being issued, a court has heard.

A Byron Bay concreter and volunteer firefighter with “strong community ties” already on bail for domestic violence charges allegedly reoffended within days of an AVO being issued, a court has heard.

Bradley McGettigan, 47, faces fresh charges of stalking/intimidation and breaching an apprehended violence order (AVO).

His lawyer described the concrete polishing business owner’s situation as a “toxic relationship” falling apart and that he faced added pressures of preparing a home for sale.

Defence solicitor Sally McPherson told Online Bail Court Division 1 the fresh allegations involved “shouting and yelling” and McGettigan had “a very different version of events” to the complainant.

In applying for bail she told the court McGettigan had strong community ties, is ranked fourth out of 20 in command at a local fire brigade, had pre-Christmas work contracts to finish, and a limited criminal record for low-range drink driving more than 20 years ago.

Police Prosecutor Sergeant Henry strongly opposed bail and told the court McGettigan had “threatened violence”.

These were “the second set of offences in a short time,” Sgt. Henry told the court.

Magistrate Karen Stafford told the court McGettigan had no prior convictions and granted him bail on Monday.

Court documents state McGettigan was first charged on November 4 with threatening to distribute an intimate image without consent — domestic violence, intentionally distributing an intimate image without consent — domestic violence, using a carriage service to menace/harass/offend, and destroying or damaging property.

On that date police applied for an AVO.

On Monday, 20 days later, the new charges were issued.

Ms Stafford told McGettigan that if he failed to appear for the next mention, he would face the possibility of spending Christmas behind bars.

McGettigan returns to Byron Bay Local Court on December 1 to face all charges where it is expected pleas will be entered.
