A North West darts player who hit an uninvited party guest in the head with a full stubbie of beer has been given community service orders after pleading guilty to wounding.
Rodney John Ramskill, 27, of Devonport, met the victim at a birthday party at a pub in the North West city on November 2, 2019.
The party later moved to Ramskill’s home and the complainant came along despite not being invited.
About 11pm, Ramskill’s landlord asked him to wind up the party and he did so.
But the complainant refused to leave and became aggressive.
He took off his jumper and put his fists up in a fighting position.
In sentencing, Justice Pearce said Ramskill then threw the stubble at him and it hit him in the head leaving a 4cm gash.
The injured man was concussed. An ambulance was called when he blacked out in the car he left the scene in.
The man was concussed for a week but had no lasting injuries other than a scar on his head.
“You used a stubble as a weapon and that was more force than you needed to defend yourself,” Justice Pearce said Ramskill.
“You did not intend to strike and wound but it was a reckless act. It is obvious to anyone throwing a stubble it is a dangerous thing to do.”
The court heard Ramskill, who works as an apprentice fitter and turner, has no prior convictions for acts of violence.
He will need to report to a parole officer and complete 56 hours of community service.
