A man has been remanded in custody on a raft of almost 20 criminal charges following a rare bail-application hearing in a rural North Queensland court.
Police took Daniel Lawrence Sinclair Brown, 45, of no fixed abode into custody at 10.30pm on Thursday prior to his appearance in the Ingham Magistrates Court about 2pm.
With three police officers present during the hearing, Brown, wearing a T-shirt, shorts, double-pluggers and a pressure bandage over his badly swollen lower-left leg, repeatedly attempted to interject despite the magistrate and his defence lawyer telling him to remain silent.
Prosecutor Kimberley Rogers-Ford said police opposed bail because of “the risk of Mr Brown failing to appear in court and reoffend”.
“As it is, Mr Brown now has on my count 18 charges before the court ranging from … drugs, property offending, unlawful use (of a vehicle) and so on Your Honour,” she addressed Acting Magistrate Rhiannan Lee.
“The charges are only growing in number and in my submission, in severity … there are no conditions (to bail) that can mitigate the risk.”
The charges listed for hearing on the external court list on Thursday were driving on a SPER-suspended licence and possessing drug utensils.
Brown, sporting an unusual shaved head and partial mullet referred to as a skullet, is yet to enter pleas to the charges and has only just filed an application for legal aid.
Magistrate Lee was immediately interrupted as she proceeded to her decision.
“Mr Brown, I just think you should let (your lawyer) talk for you.”
She noted that in terms of Brown’s criminal history, he had not been charged previously with any breaches of bail or failing to appear in court, other than a sole charge on June 10 to which the prosecution had attempted to show cause with a final ruling deferred to seek additional details.
The defence said Brown had only been released from Ingham Hospital for blood poisoning the previous day on June 9 and could not make it to court in Townsville, while Brown himself said he had been in hospital until June 10, been at death’s door and nearly lost a leg.
Magistrate Lee said her ultimate concern was “in relation to your risk of committing a further offence”.
She said there were multiple charges scheduled for mention in Ingham on June 26, spanning February through to June, “and you seem to just have numerous offences building”.
“Please Your Honour, I’ve been sick; really, really sick,” he pleaded.
She rejected his application for bail, with Brown bowing his head to stare at the floor before the officers took him from the courthouse into custody.
